Art. 1. The organizer

1.1.The organizer of the contest #MURMURMETASELFIE  is SURFACE ANATOMY S.R.L., a Romanian legal entity, with its registered office in Bucharest, Sector 3, Str. Miraslau, basement, with serial number in the Trade Register J40 / 3103/2010 and Unique Registration Code RO26697140.

 

1.2. The contest will take place in accordance with the provisions of this Official Regulation (hereinafter referred to as "Regulation"), being mandatory for all participants. This regulation is available for free consultation to all participants on the website www.murmurstore.com or at the office of the Organizer, in Bucharest, Sector 2, Dr. Burghelea Street, no. 16.

1.3. The organizer reserves the right to complete and / or amend these Regulations, as well as the right to suspend / cease / interrupt / extend the contest, provided that the participants are notified in advance. Any modification and / or completion to this Regulation will be made by additional documents, documents that will be available for consultation on the website www.murmurstore.com or at the office of the Organizer in Bucharest, Sector 2, Dr. Burghelea Street, no. 16. The organizer does not assume responsibility for the knowledge of the changes by the participants, as long as they are displayed on the website mentioned above.

 

Art. 2. Legal basis

2.2.1. This contest is organized in accordance with the provisions of Government Ordinance no. 99/2000 on the marketing of products and services on the market, republished, with subsequent amendments and completions.

Art. 3. Venue and duration of the contest

3.3.1. The contest takes place online, on Murmur Instagram Account (@murmurclothing), between January 14 and March 8, 2022 and implies the right of participation of all followers of the Murmur brand’s Instagram account, who have reached the age of 18.

 

Art. 4. Rights and conditions of participation

4.4.1. The contest is accessible to all persons who have reached the age of 18, regardless of nationality, domicile, race, sex or religion, and who comply with the conditions of this Regulation to validate their participation. Employees of the Organizer and their first-degree relatives cannot participate in the raffle. Participation in this raffle has the value of full acceptance, freely agreed and without any constraint of the provisions of this Regulation. The right to participate belongs exclusively to the participant who meets the conditions imposed by the Regulation. The right to participate in the raffle is automatically revoked if a person provides false, erroneous or inadequate data or information in addition to personal data.

 

4.2. Each participant has the right to only one raffle entry. Participants are responsible for the correctness of the data provided to the Organizer. The data provided will allow participants to be informed of the prizes won and are necessary to validate the winners.

 

Art. 5. Description of the Awards granted

 

5.5.1. Within the contest, only one Murmur Voucher will be granted (worth 400 euro), which can be used to purchase Murmur products (online on www.murmurstore.com or ar Murmur showroom- 16 Dr. Burghelea Street, Bucharest). The Winner of the unique voucher will be announced on March 8, 2022.

 

Art. 6. Mode of development

 

6.6.1. Any person who has reached the age of 18 and whoregisters in the raffle, will participate in the draw for winning a voucher worth 400 euro, according to art. 5 above.

 

6.2. Registration in the contest can be done, between January 14 and March 8, 2022, through Instagram. In order to register, participants will have to follow @murmurclothing on Instagram, take a METASELFIE (a mirror selfie with the front camera’s interface visible,  a photo of someone else’s iPhone capturing a selfie or similar kind of photos taken in other objects that reflect the image), post it on their Public story/post, tag @murmurclothing and use the hashtag #MURMURMETASELFIE and the message “or the New Self-Love Attitude. The profile of the participant has to be PUBLIC, so the Organizer can see the post Participants will also confirm that they are at least 18 years old. Once registered, all data will be verified to avoid any fraud and, if they are validated, the Organizer will confirm the registration in the raffle, within 24 hours of registration, to the e-mail address provided by the participant.

 

6.3. A participant can register only once and can win only one Murmur Voucher. Vouchers cannot be exchanged for cash.

 

6.4. The winner will be selected by random drawing, by using the application www.random.org, on March 8. The Organizer will communicate the winners of the contest through the Social Media pages and will send a private message on Instagram to the winner for the possession of the voucher.

 

6.5. The prize consisting of the Murmur Voucher can be used only for the purchase of Murmur brand products, either online or from the Murmur showroom in Bucharest, 16 Dr. Burghelea Street. The Voucher Murmur has a unique identification code, it can be used for a single purchase (of one or more products), and the code will be automatically canceled when making the payment. If the purchase value is below the value of the voucher, the Murmur Voucher user will not receive any remainder. Products purchased under this voucher cannot be returned, only exchanged.

 

Art. 7. Taxes and duties

 

7.7.1. Any tax related to the income from the prize won falls on the exclusive responsibility of the Organizer.

 

Art. 8. Processing of personal data

 

8.8.1. Registration and participation in the contest involves the provision of the Instagram username from participants who, by registering for the contest, agree to the processing of personal data by the Organizer in accordance with these Regulations, in compliance with the legislation on the protection of personal data, in particular EU Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector.

 

8.2.The organizer will process personal data collected in a secure and confidential manner and will not disclose this data to other operators.

 

Art. 9. The rights of the participants

9.9.1. Pursuant to the provisions of EU Regulation 2016/679 (art. 15), participants have the right to request from the Organizer a copy of the personal data processed. The deadline for responding to such a request is 30 days.

 

9.2.Participants may exercise the following rights:

 

-the right to access and obtain a copy of the data processed by the Organizer in respect of them;

 

-the right to withdraw consent;

 

-the right to rectify inaccurate data;

 

- the right to delete the data, if the processing is no longer necessary in order to achieve the intended purpose of the processing;

 

- the right of opposition regarding the processing based on the legitimate interest of the Organizer or the marketing communications;

 

-the right to restrict processing.

 

9.3.Participants may exercise their rights mentioned above by sending an e-mail to: eshop@murmurstore.com or a written request to the address in 16 Dr. Burghelea Street, Bucharest. Also, the participants have the right to submit a complaint to ANSPDCP, accessing the website: www.dataprotection.ro.

 

Art. 10. Final provisions

 

10.10.1. By participating in the Murmur #MURMURMETASELFIE contest, participants accept and undertake to comply with the provisions of this Regulation.

 

10.2. If, following subsequent verification, it is found that one or more of the rules of participation have not been observed, the Organizer reserves the right to cancel the prize awarded.

 

10.3. If the organization of the contest is impeded by events of major force or other objective events, the Organizer reserves the right to decide, as appropriate, the closure, extension or postponement of the contest.

 

REGULAMENTUL TOMBOLEI

„#MURMURMETASELFIE”

1. Organizatorul

 Organizatorul Tombolei„#MURMURMETASELFIE” este SURFACE ANATOMY S.R.L., persoană juridică română, cu sediul social în Bucureşti, Sectorul 3, Str. Miraslau, demisol,  având număr de ordine în Registrul Comerțului J40/3103/2010 și Cod unic de înregistrare RO26697140.

 Tombola se va derula conform prevederilor prezentului Regulament Oficial (denumit în continuare „Regulament”), fiind obligatoriu pentru toți participanții. Prezentul regulament este disponibil spre consultare în mod gratuit tuturor participanților pe website-ul www.murmurstore.com sau la punctul de lucru al Organizatorului, din București, Sector 2, Str. Dr. Burghelea, nr. 16.

 Organizatorul își rezervă dreptul de a completa și/sau modifica prezentul Regulament, precum și dreptul de a suspenda/înceta/întrerupe/prelungi desfășurarea tombolei, cu condiția înștiințării în prealabil a participanților. Orice modificare și/sau completare la acest Regulament se va face prin acte adiționale, acte care vor fi disponibile pentru consultare pe website-ul www.murmurstore.com sau la punctul de lucru al Organizatorului din București, Sector 2, Str. Dr. Burghelea, nr. 16.. Organizatorul nu își asumă răspunderea pentru luarea la cunoștință a modificărilor de către participanți, atâta timp cât acestea sunt afișate pe website-ul mai sus amintit.

2. Temeiul legal

Prezenta tombolă (loterie publicitară) este organizată în conformitate cu prevederile Ordonanței Guvernului nr. 99/2000 privind comercializarea produselor și serviciilor pe piață, republicată, cu modificările și completările ulterioare.

3. Locul de desfășurare și durata tombolei

Tombola se desfășoară online, în perioada 14 ianuarie – 8 martie 2022 și presupune dreptul de participare al tuturor persoanelor care au împlinit vârsta de 18 ani.

4. Drepturi și condiții de participare

 Tombola este accesibilă tuturor persoanelor fizice care au împlinit vârsta de 18 ani, indiferent de naționalitate, domiciliu, rasă, sex sau religie, rezidente în Romania, și care respectă condițiile prezentului Regulament pentru a-și valida participarea. Nu pot participa la tombolă angajați ai Organizatorului și nici rudele de gradul I ale acestora. Participarea la această tombolă are valoare de acceptare integrală, liber consimțită și în afara oricărei constrângeri a prevederilor prezentului Regulament. Dreptul de participare aparține în exclusivitate participantului care îndeplinește condițiile impuse de Regulament. Dreptul de participare la tombolă este anulat automat în situația în care o persoană furnizează date sau informații false, eronate sau necorespunzătoare în completarea datelor personale.

 Fiecare participant are dreptul la o singură înscriere în tombolă. Participanții răspund de corectitudinea datelor furnizate Organizatorului. Datele furnizate vor permite informarea participanților asupra premiilor câștigate și sunt necesare pentru validarea câștigătorilor.

5. Descrierea Premiilor Acordate

În cadrul tombolei va fi acordat un Voucher Murmur în valoare de 2000 lei, care poate fi folosit pentru achiziționarea produselor Murmur, pe site-ul www.murmurstore.com sau fizic, in Showroom-ul Murmur din București, Sector 2, Str. Dr. Burghelea, nr. 16.

6. Modalitatea de desfășurare

Orice persoană care a împlinit vârsta de 18 ani și care se înscrie în tombolă, va participa la tragerea la sorți pentru câștigarea unui voucher în valoare de 2000 lei, conform art. 5 de mai sus.

6.2. Înscrierea în tombolă se poate realiza, în perioada 14 ianuarie-8 martie 2022, pe platforma Instagram. În vederea înscrierii, participanții vor trebui sa urmareasca contul Murmur de Instagram (@murmurclothing), sa posteze un METASELFIE public pe story sau intr-o postare si sa foloseasca hashatg-ul #MURMURMETASELFIE(un selfie realizat in oglinda in care interfata telefonului este vizibila, o poza a telefonului mobil al unei persoane in momentul in care realizeaza un selfie sau o alta poza in aceeasi directie, realizata pe diferite suprafete care reflecta imaginea)

si mesajul “the New Self-Love Attitude”.De asemenea, participanții vor confirma că au vârsta minimă de 18 ani. Mai mult, postarea trebuie sa fie publica, fie ea story sau postare, pentru ca organizatorul sa poata sa o vizualizeze in orice caz. După ce se înscriu, toate datele vor fi verificate pentru evitarea oricăror fraude și, daca acestea sunt validate, Organizatorul va putea confirma înscrierea în tombolă, în maxim 24 de ore de la înscriere, pe adresa de e-mail comunicată de participant.

Un participant se poate înscrie o singură dată și poate câștiga un singur Voucher Murmur. Voucherul nu poate fi preschimbate în bani.

Câștigătorul va fi selectaț aleatoriu, prin tragere la sorți cu ajutorul aplicației www.random.org. în data de 8 Martie 2022. Organizatorul va comunica câștigătorul la tombolă prin intermediul paginii de Instagram (@murmurclothing) și va transmite castigatorului prin mesaj direct pe Instagram toate detaliile de intrare in posesie a premiului

Premiul constând în Voucherul Murmur va putea fi folosit doar pentru achiziționarea produselor brandului Murmur, fie online (www.murmurstore.com), fie din showroom-ul Murmur din București, Sector 2, Str. Dr. Burghelea, nr. 16. Fiecare Voucher Murmur are un cod unic de identificare, va putea fi folosit la o singură achiziție (de unul sau mai multe produse), iar codul va fi anulat automat la efectuarea plății. Dacă valoarea achizitiei este sub valoarea voucher-ului, utilizatorul Voucherului Murmur nu va primi rest. Produsele cumpărate în baza acestui voucher nu pot fi returnate, ci doar schimbate.

7. Taxe și impozite

Orice impozit aferent venitului din premiul câștigat cade în sarcina exclusivă a Organizatorului.

8. Prelucrarea datelor cu caracter personal

Înscrierea și participarea la tombolă poate implica furnizarea de date cu caracter personal (nume, prenume, e-mail) din partea participanților care, prin înscrierea la tombolă, își dau acordul pentru prelucrarea datelor cu caracter personal de către Organizator conform prezentului Regulament, cu respectarea legislației privind protectia datelor cu caracter personal, în special Regulamentul EU 2016/679 privind protecția persoanelor fizice în ceea ce privește prelucrarea datelor cu caracter personal și privind libera circulație a acestor date și Legea nr. 506/2004 privind prelucrarea datelor cu caracter personal și protecția vieții private în sectorul comunicațiilor electronice.

Organizatorul va prelucra datele cu caracter personal colectate în condiții de siguranță și confidențialitate și nu va dezvălui aceste date altor operatori.

9. Drepturile participanților

În temeiul dispozițiilor Regulamentul EU 2016/679 (art. 15), participanții au dreptul de a solicita Organizatorului o copie a datelor cu caracter personal prelucrate. Termenul de răspuns la o astfel de solicitare este de 30 de zile.

 Participanții își pot exercita următoarele drepturi:

• dreptul de acces și de obținere a unei copii a datelor prelucrate de Organizator în ceea ce îi privește;
• dreptul de retragere a consimțământului;
• dreptul de rectificare a datelor inexacte;
• dreptul de ștergere a datelor, în cazul în care prelurarea nu mai este necesară în vederea atingerii scopului preconizat al prelucrării;
• dreptul de opoziție în ceea ce privește prelucrările întemeiate pe interesul legitim al Organizatorului sau comunicările de marketing;
• dreptul de restricționare a prelucrării.

Participanții își pot exercita drepturile menționate mai sus prin transmiterea unui e-mail, la adresa: (*) sau a unei cereri scrise la adresa din București, Sector 1, Str. Icoanei nr. 75A. De asemenea, participanții au dreptul să depună o plângere la ANSPDCP, accesând site-ul: www.dataprotection.ro.

10. Dispoziții finale

Prin participarea la tombola Murmur Giveaway, participanţii acceptă și se obligă să respecte prevederile prezentului Regulament.

În cazul în care, în urma unor verificări ulterioare, se constată că una sau mai multe dintre regulile de participare nu au fost respectate, Organizatorul își rezervă dreptul de a anula premiul acordat.

În cazul în care organizarea tombolei este împiedicată de evenimente de forță majoră sau de alte evenimente obiective, Organizatorul își rezervă dreptul de a decide, după caz, încheierea, prelungirea sau amânarea tombolei.
